Some controversial issues related to this holy prophet have been raised in Sunni and Shi’ite exegeses; for instance, the interpretations regarding the 44th verse of Surah “Sad”. By using the descriptive and analytical method, the present study aims to critically review the Sunni and Shi’ite exegetical views on the interpretation of the 44th verse of Surah “Sad”. The results of the study indicate that 2 important arguments about this Qur’anic verse are under discussion between Sunni and Shi’ite scholars and commentators: first, the reason of swear and the person who is hit; second, the jurisprudential usage of the verse. As for the first argument, the interpretation of the verse points to the swear of Prophet Job (PBUH) to hit his wife and the punishment mitigation ordered by God but the purpose of swear by the Prophet and his wife’s fault are not explicitly mentioned for the sake of respect and decency. As for the potential of jurisprudential usage of the verse, the Islamic jurists and commentators have proposed 4 jurisprudential perceptions including “the punishment of a sick adulteress”, “the swear of a master to punish his servant”, “hitting a wife who is not obstinately disobedient”, and “the permission of religious deceit”. There are various fallacies against all the above interpretations indicating that the circumstances in this verse relate to a particular condition specially for the case of Prophet Job (PBUH) so it does not involve other religions or persons. © Muhammad Ja’fari, R; Aslani, M. Doi: 10.22091/ptt.2020.4371.1560 نقد و بررسی آراء تفسیری فریقین در تفسیر آیه 44 سورۀ «ص» رسول محمدجعفری* | مهدی اصلانی** تاریخ دریافت: 07/09/1398 | تاریخ پذیرش: 25/01/1399 چکیده یکی از پیامبران برجستۀ الهی که در قرآن، نام ایشان در چند نوبت و چند سوره یاد شده، حضرت ایوب(ع) است. دربارۀ این پیامبر الهی، چندین موضوع چالش‌برانگیز در تفاسیر فریقین انعکاس یافته که از جملۀ آنها، مباحثی است که در آیه 44 سورۀ «ص» مطرح می‌باشند و برخی آراء تفسیری ارائه شده ذیل این آیه در معرض نقد جدی هستند، ازاین‌روی پژوهش حاضر با روش توصیفی و تحلیلی در صدد پاسخ به این سؤال است که نقد و بررسی آرای تفسیری فریقین در تفسیر آیه 44 سوره «ص» چگونه است؟ یافته‌های تحقیق حکایت از آن دارند که در این آیه، دو مسئلۀ مهم میان عالمان و مفسران فریقین مطرح بوده است؛ نخست، علت سوگند و فرد مضروب؛ و دوم، امکان استفادۀ فقهی از آیه. دربارۀ مسئلۀ نخستین اجمالاً می‌توان گفت سیاق آیه به سوگند ایوب(ع) بر مضروب ساختن همسرش و حکم تخفیف الهی اشاره دارد و براى رعایت ادب و حفظ احترام، دقیقاً سبب سوگند آن حضرت و خطای همسرش ذکر نشده است. در خصوص امکان استفاده فقهی از آیه نیز، فقها و مفسران چهار برداشت فقهی ارائه کرده‌اند که عبارتند از «جاری کردن حد بر زناکار بیمار»، «سوگند مولا بر تنبیه عبد»، «ضرب همسر در غیر نشوز» و «جواز حیله شرعی». به همۀ این برداشت‌ها اشکالات متعددی وارد شده است، اما اشکال تقریباً مشترک همۀ آنها این است که آنچه در آیه مطرح گردیده از احکام اختصاصی ایوب(ع) است و دلیلی بر الغای خصوصیت از ایشان و تعمیم به دیگر شرایع و یا تعمیم به اشخاص دیگر، وجود ندارد. © محمدجعفری، ر؛ اصلانی، م.
